Zarin & Steinmetz was retained by defendants, owners of a Staten Island property. The defendants had faced a contract lawsuit from the property’s former seller, which they chose to settle. However, shortly after settlement, it was discovered the former seller had allegedly hidden significant environmental contamination on the site. Since this critical information was allegedly concealed, the defendant asserted that the original settlement was induced by fraud.
Z&S attorneys Lee Lefkowitz and Aaron Warner filed an emergency Order to Show Cause with the Kings County Supreme Court. This filing asked the judge to take the extraordinary step of staying the prior settlement and reinstating the original lawsuit. We are pleased to announce that the Court issued the Temporary Restraining Order Z&S requested.
