Z&S Wins Dismissal for Telecommunications Subcontractor in Amended Complaint Case

Z&S Attorney Jacob Amir obtained complete dismissal of an action brought against a subcontractor telecommunications company for claims alleging conversion, fraud, negligent hiring and supervision, and intentional and negligent infliction of emotional distress.

The Plaintiff claimed money damages against several parties, including our client and a major telecommunications service provider, arising from installation services and the alleged removal or theft of certain valuable personal property. While another defendant answered the complaint, Jacob prepared a thorough dismissal motion refuting each of the claims on various legal grounds. Three other defendants adopted our arguments in their own dismissal motion. The Plaintiff cross-moved to amend the complaint in an attempt to overcome the deficiencies in the claim shown in our motion.

The Court granted our motion in its entirety, dismissed the action against our client (as well as the other moving defendants who adopted our argument) and denied the Plaintiff’s cross-motion.
