Helen Mauch & Kate Roberts recently obtained a Certificate of Completion (“COC”) under the Brownfield Cleanup Program from the New York State Department of Environmental Conservation for EPR Properties in connection with the development of EPR’s 1,700 acre site in the Town of Thompson. EPR’s property in Thompson, New York is home to Resorts World Catskills casino and hotel. When complete, the destination resort will also include a waterpark and hotel, renovated “Monster” golf course and Entertainment Village hotel with retail and restaurants. Working closely with a team of environmental consultants, Mauch and Roberts guided EPR through the Brownfield Cleanup Program, including the application process, Brownfield Cleanup Agreement, and Environmental Easements, before securing the COC for four (4) operable units on the site. Issuance of the COC allows EPR to benefit from brownfield tax credits, and also offers significant liability protection.
