David Steinmetz and Lee Lefkowitz successfully represented Dakota Supply Corp and a series of other entities that own and operate a contractor’s yard in the Town of Cortlandt. 

Partnering with the Town, Z&S defended an Article 78 proceeding brought by another property owner who attempted to challenge and overturn a site plan approval that allowed Z&S’s client to operate on the site. After Z&S prevailed at the lower court, Z&S went on to defend the appeal. Lee Lefkowitz conducted oral arguments at the Appellate Division, Second Department, after which the Court rendered a decision affirming the lower court and dismissing the Article 78 challenge, finding it was barred by the statute of limitations.
